Following the Supreme Court’s unanimous decision on Monday to maintain former President Trump’s place on presidential primary ballots in the face of many lawsuits from states looking to remove him from office, left-leaning organizations reaffirmed their long-standing demands to see more justices appointed to the bench.
The nine justices comprising the Republican-appointed majority of the Supreme Court, with a vote of 6-3, concluded that states lack the authority to disqualify candidates and incumbents for federal office. Section 3 of the 14th Amendment forbade Trump from running for office, and the judges overturned the Colorado Supreme Court’s determination that Trump had participated in rebellion in their six-page judgment. Nevertheless, several activist groups continued to criticize the Supreme Court’s ruling despite the consensus.
In the hours following the Supreme Court’s ruling in Anderson v. Trump, the left-leaning legal organization Demand Justice posted on X, then known as Twitter, with the slogan “Expand the Court.” The organization released a similar online statement to “EXPAND THE COURT” in reaction to the high court’s ruling, even though it did not directly link its request to the ruling. This was in addition to other left-leaning organizations like the Women’s March.
Usually associated with far-left attempts to appoint more than nine justices to the Supreme Court, the idea of expanding the court here is meant to counteract the 6-3 GOP-appointed majority that was established under former President Donald Trump’s administration, in which Trump was successful in appointing Justices Brett Kavanaugh, Neil Gorsuch, and Amy Coney Barrett during his one term in office.
Demand Justice, a longtime advocate of court filling, accepted $4.5 million from the George Soros-funded Open Society Policy Center in 2021 and used the money to purchase advertisements opposing Barrett, the 2020 candidate. Additionally, it has backed the Democratic-led Judiciary Act, which aims to increase the number of Supreme Court seats by four as well as remove the filibuster. The organization has been under investigation since 2022 tax papers revealed what seemed to be $291,609 in alleged “misuse of organization money by its previous finance director.”
According to Carrie Severino, president of the conservative JCN, previously known as Judicial Crisis Network, “just on cue, left-wing dark money groups are pushing for court packing anytime they obtain a judgment they don’t like (including one with a unanimous vote),” according to the Washington Examiner.
The fact that they would need to add 10 Justices in order to overturn this ruling is revealing; it implies they do not believe Justices Kagan, Sotomayor, and Jackson are liberal enough for them. Severino continued, “It demonstrates how extreme and out of touch these groups are, as well as how reflexively political a judge would have to be to satisfy their criteria.
Demand Justice, a group that has been pushing for members, including the retired Justice Stephen Breyer, to resign from the bench so that President Joe Biden can appoint a younger justice to the Supreme Court, is calling for the appointment of more justices to the court.

This sort of thing can happen in a Democracy where the rule of numbers previels but “never” in a Republic where individual rights are to be enforced. That’s why you will “never” hear a Democrat use the word Republic.
