You can probably throw aside whatever reservations you may have had about whether FBI leadership allowed political prejudice to influence the agency’s personnel decisions. It seems that the agency has been eliminating workers with incorrect political beliefs, and it hasn’t even been tactful about it.
The U.S. Department of Justice Inspector General, Michael Horowitz, received a letter on Saturday from Tristan Leavitt, President of Empower Oversight, “a nonpartisan organization dedicated to enhancing the independent oversight of government and corporate wrongdoing.” The letter detailed the agency’s abuse of the security clearance rules to force out employees with disfavored views.
The letter and the exhibits it attaches describe an unsettling procedure the agency used that resulted in Empower’s client having to retire early. Leavitt raised several key issues.
“For twelve years, our client gave honorable service to the FBI, earning both cash rewards and excellent performance reviews. In March 2022, then-FBI Executive Assistant Director (“EAD”) Jennifer Leigh Moore revoked our client’s security clearance, resulting in an unpaid, indefinite suspension. Not long afterward, our client made private and classified disclosures to the House Judiciary Committee, accusing them of political interference and misuse of the security clearance procedure in this particular case, as well as others.”
“We made an additional protected disclosure for our client to you directly and to the Office of Inspector General (“OIG”) regarding the FBI’s misuse of the security clearance process a year later, in March 2023, after Empower Oversight started representing the client.”
“EAD In April 2023, Moore withdrew our client’s security clearance. In accordance with the FBI’s internal appeal procedure, Empower Oversight sought copies of the SecD investigative file. We got some (but not all) of the paperwork we thought we needed to prepare our client’s appeal in January 2024.
View the questions the FBI sent to the client’s colleagues, advising them that failing to provide complete and accurate answers could lead to the revocation of their own security clearances.
As Leavitt correctly notes in the letter, holding and expressing the opinions expressed in the questionnaire constitutes protected First Amendment activity. It’s fascinating to note that, while endorsing right-leaning, conservative, and pro-Trump views, the client never employed vocabulary critical of the government or the FBI in his questionnaire replies from his client’s coworkers. The comments indicate that the individual is a staunch supporter of the Second Amendment, disagrees with COVID mask laws and immunization requirements, and is sympathetic to former President Donald Trump, which is unrelated to whether or not he poses a threat to national security.
Leavitt further stresses that the FBI has good reason to revoke security clearances in certain situations and that the initial investigation into his client was lawful. The problem lies in the fact that this was not one of those situations, and the FBI’s defensive tactics conceal a corruption that requires attention.
